This Privacy Policy explains how Trademark Public Search ("TMPS", "we", "us", "our") collects, uses, stores, and protects your personal data when you use tmpublicsearch.com. We comply with the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable Indian data protection laws.
Plain English Summary
We collect your name, mobile number, and search query when you use our free trademark search tool. We use it to provide the service, follow up if you want help filing, and send you relevant updates. We don't sell your data. You can ask us to delete it any time.
1. Information We Collect
1.1 Information you provide directly
- Search lead form: Your name and 10-digit mobile number, submitted before you can run a trademark search.
- Registration inquiry form: Your name, mobile number, email address, the brand you wish to register, optional class preference, and any optional message you provide.
- Search query: The brand name you type into the search box.
1.2 Information collected automatically
- IP address: Used solely to enforce the daily search limit (2 free searches per IP per day) and prevent abuse.
- Browser user-agent: A string identifying your browser and operating system, logged for security and diagnostics.
- Timestamp: Date and time of each interaction.
- Cookies / local storage: A small token stored in your browser remembers that you've already submitted the lead form, so you don't have to re-fill it on every search in the same browser.
We do not collect: payment information, government IDs (Aadhaar, PAN), passwords, biometric data, geolocation beyond IP, or any data classified as sensitive personal data under the DPDP Act unless you voluntarily submit it in the optional message field.
2. Purpose and Lawful Basis
We process your data on the basis of your specific consent (DPDP Act §6), which you provide via the consent checkbox on our forms. Specifically, we use your information to:
- Operate the trademark search service and display results.
- Enforce fair-use limits and prevent automated abuse.
- Contact you (via call, SMS, WhatsApp, or email) about your search, to offer a free consultation, or to provide trademark filing services if you've expressed interest.
- Send you relevant updates about IP services, trademark law changes, or new features (you may opt out at any time).
- Improve the service through aggregated, anonymized analytics.
3. Sharing of Information
We do not sell your personal data. We may share it only:
- With our trademark filing partners (IP attorneys, agents) only if you have submitted the registration inquiry form and consented to be contacted for filing services.
- With service providers who help us operate the website (hosting, email delivery, analytics). These providers are contractually bound to use your data only for the agreed purpose.
- If required by law (court order, lawful government request) or to protect our legal rights.
4. Third-Party Data Source
Trademark search results are sourced from publicly available trademark records via third-party data aggregators. Information shown about existing trademarks (proprietor name, application number, status, etc.) is public-record data and not personal data we have collected from you.
5. Data Retention
We retain your data only as long as necessary for the purposes described:
- Search lead records: Up to 24 months from the date of submission, after which they are deleted or anonymized.
- Registration inquiry records: Up to 5 years (to comply with tax and professional-services record-keeping obligations).
- IP rate-limit data: Automatically purged at the end of each day.
- Local storage cookie: Until you clear your browser data or until 12 months, whichever is sooner.
6. Your Rights Under the DPDP Act
As a Data Principal under the DPDP Act, 2023, you have the following rights:
- Right to access: Request a copy of the personal data we hold about you.
- Right to correction and erasure: Request correction of inaccurate data, or request that we delete your personal data.
- Right to grievance redressal: Raise a complaint with our Grievance Officer (see Section 11) about how your data is being handled.
- Right to nominate: Nominate another individual to exercise your rights in case of incapacity or death.
- Right to withdraw consent: Withdraw your consent at any time. This will not affect the lawfulness of any processing we did before the withdrawal.
To exercise any of these rights, email us at care@iprights.in with the subject line "DPDP Request". We will respond within 30 days.
7. Data Security
We use reasonable technical and organizational measures to protect your data, including HTTPS encryption in transit, restricted server access, and limited internal access on a need-to-know basis. However, no system is 100% secure — if you suspect a breach, contact our Grievance Officer immediately.
8. Children's Privacy
Our service is not intended for individuals under 18 years of age. We do not knowingly collect personal data from minors. If you are a parent or guardian and believe your child has provided data to us, contact us and we will delete it.
9. Cookies & Local Storage
We use a single browser-side localStorage token (tmps_lead_v1) to remember your name and mobile after your first form submission, so you don't have to re-enter it on every search. We do not use third-party advertising cookies or cross-site tracking. You can clear this storage any time via your browser settings.
10. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top will reflect the most recent revision. Material changes will be communicated via a banner on the website or email (if you've shared your email with us).
