Trademark FAQ India 2026: 50 Most Asked Questions Answered
General Questions
What is a trademark?
Any word, name, logo, symbol, colour, sound, or shape that identifies the source of goods or services. A registered trademark gives exclusive nationwide rights for 10 years, renewable forever.
Is trademark registration mandatory in India?
Not legally mandatory, but strongly recommended. Without registration, anyone can legally use a confusingly similar name. Registration gives you exclusive rights, legal standing to sue, and platform brand registry access.
What is the difference between a trademark and a brand name?
Your brand name is what you call your business. A trademark is the legal registration that makes that name exclusively yours. All registered trademarks are brand names, but not all brand names are registered trademarks.
Fees and Costs
How much does trademark registration cost in India?
Government fee: ₹4,500 per class (individual/MSME/startup, online) or ₹9,000 per class (company/LLP). Attorney fees are additional — typically ₹3,000–8,000 for a straightforward application.
Why is there a lower fee for MSMEs?
The Trade Marks Rules, 2017 introduced concessional fees for individuals, MSMEs with Udyam registration, and DPIIT-recognised startups to encourage brand registration among small businesses.
Does renewal cost the same as registration?
No. Renewal (Form TM-R) costs ₹9,000 per class for ALL applicant types — there is no concessional MSME rate for renewal, unlike the registration fee.
Process and Timeline
How long does trademark registration take in India?
18–24 months for a smooth application without objections. Applications with objections take 24–36 months. Contested oppositions can take 2–4 years.
Can I use my trademark while it is pending?
Yes — use ™ from the date you file. ® is only permitted after the registration certificate is issued.
What happens if I miss the 30-day objection reply deadline?
Your application is automatically treated as abandoned. You lose your filing fees and must start over with a fresh application, losing your original filing date priority.
Symbols and Rights
What is the difference between ™ and ® in India?
™ can be used from the filing date — it's a claim of trademark rights, not proof of registration. ® can ONLY be used after the registration certificate is received. Using ® before registration is a criminal offence under Section 107 of the Trade Marks Act.
Is using ® before registration illegal in India?
Yes — it is a criminal offence under Section 107 of the Trade Marks Act, 1999, punishable with imprisonment up to 3 years and/or a fine.
Classes and Coverage
How many trademark classes are there in India?
45 classes — Classes 1–34 cover goods (physical products) and Classes 35–45 cover services. India uses the Nice Classification 11th Edition.
Do I need to register in multiple classes?
If your business covers multiple sectors, yes. Your trademark only protects you in the classes you file in. A clothing brand that also retails online should file in both Class 25 (clothing) and Class 35 (retail services).
Can I trademark a name that is also used in another country?
A trademark in India gives you rights only in India. If you are already using the name in another country, you may be able to claim priority and file in India within 6 months (Paris Convention). Check if the name is available in India's IP India database — it's a separate register from foreign trademark offices.
How do I check if my trademark application was successful?
Check status on ipindiaonline.gov.in → Trade Marks → Status of Application → enter your application number. When status shows 'Registered', your certificate is available for download.
Can a trademark be cancelled after registration?
Yes — through a cancellation/rectification petition filed at the relevant High Court (after IPAB dissolution). Common grounds: non-use for 5+ years, obtained by fraud, mark became generic, or conflicts with a well-known trademark.
What is the validity period of a trademark in India?
10 years from the date of filing (not from the date of registration). Renewable every 10 years indefinitely by filing Form TM-R and paying ₹9,000 per class.
