Most trademark registrations protect a brand within its specific class(es). But well-known trademarks in India receive a much higher level of protection — they are protected across all 45 trademark classes, even for completely unrelated goods and services. This is the highest level of trademark protection available under Indian law.

What Is a Well-Known Trademark?

Under Section 2(1)(zg) of the Trade Marks Act, 1999, a well-known trademark is one that has become well-known to a substantial segment of the public — in India or internationally — and whose reputation extends beyond the class in which it is registered.

Well-known status means the Trade Marks Registry and courts will:

  • Refuse registration of identical or similar marks in ANY class (not just your class)
  • Give your mark protection even if the goods/services are completely unrelated
  • Presume damage from dilution of your mark without proof of actual confusion

How Is a Mark Deemed Well-Known?

The Registrar considers several factors:

  • The extent to which the mark is known in India — among the relevant public and general public
  • Duration, extent, and geographical area of use
  • Duration, extent, and geographical area of promotion
  • Duration and geographical area of registrations
  • Record of successful enforcement — court decisions in the mark's favour
  • Whether the mark has been determined as well-known by courts or the Registrar previously

How to Apply for Well-Known Status in India

As of the Trade Marks Rules, 2017, any trademark owner can file an application requesting the Registrar to determine their mark as well-known:

  1. File Form TM-M with the Trade Marks Registry (Delhi jurisdiction for national applications)
  2. Submit evidence establishing the mark's reputation: survey reports, advertising expenditure, sales figures, media coverage, court judgments
  3. Pay the prescribed fee
  4. The Registrar will examine and may include the mark in the list of well-known trademarks maintained on the IP India website

Historically, most well-known trademark determinations in India came through High Court or Supreme Court decisions rather than administrative applications. Courts recognised marks like APPLE, GOOGLE, MICROSOFT, and ROLEX as well-known based on their global and Indian reputation.
